4. Estimates & Project Agreements

Any estimate or proposal provided through or following an inquiry on this website is preliminary and non-binding until incorporated into a signed written contract. Consistent with Minnesota law, all residential construction contracts and change orders are reduced to writing and include a detailed summary of the services to be performed, the materials to be used, the project schedule, and the total contract price. The signed written contract governs the rights and obligations of both parties.

5. Warranties

Vialencia Construction stands behind its workmanship with a 10-year workmanship warranty on qualifying projects, as detailed in the written contract. Manufacturer warranties for materials and products are passed through to the owner subject to the manufacturer’s terms. Warranty specifics, exclusions, and remedies are set forth in the applicable written contract, which controls in the event of any inconsistency with this website.

6. Permits, Codes & Compliance

We perform work in accordance with applicable Minnesota State Building Code provisions and local municipal permitting requirements. Where required, permits are obtained and inspections scheduled as part of the contracted scope of work.

7. Insurance & Licensing

Vialencia Construction is fully licensed and insured. Proof of insurance and licensing is available upon request. We maintain coverage appropriate to the scope of each project as set forth in the written contract.

8. Dispute Resolution

We are committed to resolving concerns promptly and in good faith. For residential projects, Minnesota law provides specific remedies and procedures for the resolution of construction disputes. Any dispute arising out of or relating to these Terms or a project shall, to the extent permitted by law, be governed by the dispute resolution provisions of the signed written contract. In the absence of a controlling contract provision, disputes shall be resolved in the state or federal courts located in Minnesota, and you agree to the personal jurisdiction of those courts.

9. Limitation of Liability

To the fullest extent permitted by law, Vialencia Construction shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website. This website is provided “as is” without warranties of any kind, express or implied. Nothing in these Terms limits any rights you may have under Minnesota law that cannot be waived.
